Edison Electric Institute (EEI), an association of investor-owned utilities across the United States, developed many of the tests. EEI Practice Tests (login required) are available to help learn about and prepare for these pre-employment tests.

Senior Attorney / Associate General Counsel

Responsibilities

This position provides legal services on electric FERC matters, in particular transmission, interconnection and compliance. Otter Tail Power Company operates primarily in the MISO region and is involved with several FERC regulatory cases each year, and intervenes in numerous FERC electric proceedings filed by other entities, including MISO and SPP market design and tariff proceedings. Otter Tail Power Company has a highly integrated transmission system and this position is responsible for drafting, negotiating and causing the filing of any joint ownership or interconnection agreements.  This position is responsible for negotiating on behalf of Otter Tail Power Company the numerous generator interconnection agreements in accordance with the MISO Tariff and is furthermore responsible for the legal and regulatory aspects of siting new or upgraded transmission facilities, whether driven by interconnection or load demand.  The position will also support state regulatory recovery aspects involving the applicable FERC regulatory decisions, as appropriate. 

Qualifications

Essential Responsibilities

Provides counsel to Otter Tail Power company management on legal, business and strategic issues.

  • Prepares or reviews contracts, agreements and other documents, inclusive of procurement of goods and services.
  • Provides counsel regarding compliance with FERC filing obligations.
  • Provide opinions on policy questions and legal implications of Otter Tail Power Company operations.
  • Prepares and provides counsel regarding rights of way, easements and real estate purchases.
  • Represents Otter Tail Power Company in courts, local and state governmental proceedings, regulatory agencies and other adjudicatory or adversarial proceedings.
  • Represents Otter Tail Power Company before FERC, in courts and before other adjudicatory or adversarial proceedings.

 Required for Senior Attorney

J.D. degree from an American Bar Association (ABA) accredited law school.

  • Must be licensed to practice in any of the states of Minnesota, North Dakota or South Dakota (or able to qualify for reciprocity within 12 months).
  • 4 - 6 years of practice in corporate law department, law firm, government practice Strong verbal and written communication skills.
  • Some experience with rights of way and land purchases.
  • Experience with negotiation and drafting of engineering, procurement and construction agreements.
  • Substantial experience in FERC electric regulatory matters.

 Required for Associate General Counsel

J.D. degree from an American Bar Association (ABA) accredited law school.

  • Must be licensed to practice in any of the states of Minnesota, North Dakota or South Dakota (or able to qualify for reciprocity within 12 months).
  • Eight or more years of practice in corporate law department, law firm, government practice or equivalent legal experience.
  • Superior verbal and written communication skills.
  • Significant transactional experience relating to joint usage rights .
  • Experienced with negotiation of engineering, procurement and construction agreements.
  • Experienced with environmental aspects of siting and permitting.
  • Significant real estate and rights of way training and experience.
  • Substantial experience in FERC electric regulatory matters, including leading contested administrative hearings and settlement procedures.
